By accessing, browsing, or using Healthy Living Strength's website, patient portal, mobile interfaces, telehealth platforms, or healthcare services, you acknowledge that you have read, understood, and agree to these Terms. These Terms apply to all users including patients, visitors, authorized representatives, and healthcare providers.
You must be at least 18 years old to establish care independently. Minors require consent from a parent or legal guardian. You must provide accurate, complete, and current information during registration. We reserve the right to verify age, identity, insurance eligibility, and legal authority at any time.
Healthy Living Strength does not provide emergency medical care. If you are experiencing a medical emergency including chest pain, difficulty breathing, severe bleeding, sudden numbness, loss of consciousness, or suicidal thoughts, call 911 immediately or go to the nearest emergency room. Our patient portal and messaging systems are not monitored 24/7 for urgent medical needs.
We provide primary care, telehealth consultations, specialist referrals, preventive health services, chronic disease management, mental health support, wellness programs, and health education. Clinical services are delivered by licensed independent practitioners who follow their own professional standards and clinical judgment within their scope of practice.
By accepting these Terms, you acknowledge that you have been informed about the potential benefits, risks, alternatives, and possible side effects of recommended treatments. You agree to disclose all relevant health information including medications, allergies, supplements, and medical history. You may withdraw consent for specific treatments at any time.
Licensed practitioners including physicians, nurse practitioners, and physician assistants are independent contractors or employed clinicians, each responsible for their own clinical judgments, diagnoses, treatment decisions, and professional conduct. Healthy Living Strength facilitates administrative coordination but does not direct or interfere with independent clinical practice or medical judgment.
Appointments are subject to provider availability and may be scheduled online or by phone. We require 24 hours' notice for cancellations or rescheduling. Late cancellations (less than 24 hours) incur a $50 fee. No-shows without any notice incur the full appointment fee. Exceptions may be made for genuine emergencies at our sole discretion.
Payment is due at the time of service unless insurance verification is completed in advance. We accept credit cards, debit cards, HSA, FSA, and cash payments. For approved insurance plans, we will bill your carrier directly as a courtesy. You remain fully responsible for any copays, deductibles, coinsurance, or uncovered amounts regardless of insurance determinations.
Balances unpaid after 60 days may accrue interest at 1.5% monthly (18% APR). Accounts over 90 days past due may be referred to a collections agency. You are responsible for any collection costs, attorney fees, or legal expenses incurred to recover unpaid balances as permitted by USA law and the federal Fair Debt Collection Practices Act.
We make reasonable efforts to verify insurance coverage and benefits prior to services, but we cannot guarantee coverage amounts, payment timing, or claim approval. Coverage determinations are solely made by your insurance carrier based on your specific plan. You are responsible for understanding your plan's benefits, limitations, exclusions, and out-of-network policies. We are not liable for coverage denials or unexpected patient balances.
Prescriptions for medications are issued at practitioner discretion based on clinical need, medical history, and applicable laws. We comply with all federal DEA regulations and state controlled substance laws. You are responsible for disclosing all current medications, supplements, and allergies to avoid adverse interactions. We do not prescribe controlled substances via telehealth in all states.
Our patient portal provides secure messaging, appointment scheduling, telehealth video visits, prescription refill requests, and medical record access. You are responsible for maintaining the confidentiality of your login credentials. Portal messages are not monitored for emergencies. We may communicate with you via email, SMS text messages, or push notifications as permitted by your consent and applicable law.
Healthy Living Strength does not guarantee specific health outcomes, cure rates, or treatment success. Individual responses to treatments vary significantly based on genetics, adherence to care plans, concurrent medical conditions, lifestyle factors, and other variables. Testimonials on our website reflect individual experiences and are not guarantees of your personal results. Past clinical outcomes do not predict future results.
Services and platform are provided "as is" and "as available" without warranties of merchantability, fitness for a particular purpose, title, non-infringement, or accuracy. We do not warrant that the platform will be uninterrupted, error-free, secure, free of viruses, or that defects will be corrected. Some jurisdictions do not allow warranty disclaimers, so this provision may not apply to you.
To the maximum extent permitted by USA law, Healthy Living Strength's total liability for any claim arising from these Terms or your use of our services is limited to the fees you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages including lost wages, pain and suffering, emotional distress, loss of health improvement expectations, or medical complications.
You agree to indemnify, defend, and hold Healthy Living Strength harmless from any claims, damages, losses, liabilities, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your failure to disclose accurate health information, your misuse of our services, or your infringement of any third-party rights including medical malpractice claims against independent practitioners.
These Terms are governed by the laws of the United States of America, without regard to conflict of laws principles. Any dispute arising from these Terms shall be governed by USA and applicable federal law including HIPAA, the Affordable Care Act, and the Federal Arbitration Act.
Any dispute shall first be attempted to resolve informally for 30 days via written notice to info@healthylivingstrength.com. If unresolved, disputes shall be resolved through binding arbitration under AAA Consumer Arbitration Rules in USA. You waive the right to a jury trial, class actions, class arbitrations, and representative actions. For permitted court proceedings (e.g., injunctive relief, small claims), venue shall be exclusively in USA.
We may suspend or terminate your patient relationship immediately, without prior notice, for violation of these Terms, non-payment of outstanding balances, suspected fraud, insurance fraud, abusive or threatening behavior toward staff, or as required by law or regulatory authority. You may terminate your patient relationship at any time by providing written notice. Upon termination, you remain liable for outstanding fees and may request transfer of your medical records to another provider.
These Terms constitute the entire agreement between you and Healthy Living Strength, superseding any prior agreements or understandings.
